June 23, 2017. Washington, D.C. Today President Trump signed the Department of Veterans Affairs Accountability and Whistleblower Protection Act into law.

The law aims to protect whistleblowers from retaliation and reprisal and will require training of all VA employees about whistleblower protections. The Veterans Affairs (VA) Whistleblower Office  created by President Trump in April becomes permanent under the new law.

On July 30, the U.S. Senate’s Kennedy Caucus Room was packed with whistleblowers, their families and whistleblower advocates as six senators and one representative each gave moving remarks in recognition of National Whistleblower day. This event, hosted by the National Whistleblower Center, marked the first Congressional celebration of National Whistleblower Day. The commemoration of July 30th as National Whistleblower Day recognizes the passage of the first ever whistleblower law that date in 1778, as well as the crucial role whistleblowers play today in defending our nation from waste, fraud and abuse.

In January the U.S. Office of Special Counsel (OSC) proposed a rule that it claims would extend protections under the Civil Service Reform Act and the Whistleblower Protection Act to employees of federal contractors.  However, as my previous blog on this proposed rule stated, the unintended consequences of this rule may cause more harm than good for employees of federal contractors.

On Monday, March 23, the National Whistleblower Center (NWC) filed comments on the proposed rule. The submission by the NWC cautioned OSC stating “we believe that part of the proposed rule should be modified to ensure that employees of contractors are aware of their rights under the False Claims Act, and the part pertaining to disclosure of classified information should be withdrawn until further clarification about the use and handling of classified information is provided.”

Urge Attorney General Holder to Investigate KBR and Support Whistleblowers!

KBR, Largest Defense Contractor in Iraq About to Score Big Victory Against Whistleblowers

Kellogg Brown & Root (KBR) is sitting on documents that contain proof of millions of dollars in government contract fraud. A trial court reviewed these documents and found them to be “eye openers” and ordered their release. KBR filed an emergency appeal to the U.S. Court of Appeals for the D.C. Circuit seeking to hide the documents. Unfortunately, at that stage of the case the Department of Justice sat silent. The whistleblower was on his own to fight the intense legal arguments filed by KBR, the U.S. Chamber of Commerce and numerous other corporate lobby group. In a major setback in the fight against corporate fraud, the Court of Appeals granted KBR’s motion, allowing it to hide direct evidence of contact fraud.
